Privacy Statement

Our Privacy Policy, which applies to your use of the Platform, covers the gathering and use of

a. Product and service sales: We may be required to disclose your personal information with

other parties in order to provide services or products purchased from third parties on our

marketplace.

b. Collaboration with third-party service providers: We may contract with third-party firms

to perform specific duties on our behalf. Some examples include completing orders for

products or services, delivering items, analyzing data, aiding with marketing, processing

payments, distributing information, assessing and managing credit risk, and giving

customer assistance.

c. Business transfers: As our firm expands, we may sell or buy additional businesses or

services. In such transactions, customer information may be transferred with other

e. We shall respond if a competent legal authority, such as an investigating agency,

f. For promotional purposes. Fitmore may utilise your material for marketing and

promotional objectives associated with the brand, such as wearing Fitmore products or

services, and may publish it on the Platform or its social media accounts.

Our Security Measures

We have put in place the essential safeguards to prevent your personal information from being

accidentally lost, used or accessed in an unauthorized way, modified, or disclosed. Furthermore,

access to your personal data is restricted to employees, agents, contractors, and other third parties

with a valid business need to know. They will only process your personal data if we instruct

them to, and they are bound by a duty of confidentiality. Remember that no internet security

system is entirely secure, but we try our best to keep your data as secure as possible.

Amateur Athletes Notice

You must ensure that your activity on the Platform does not jeopardize your status as an amateur

athlete. Please confirm the rules that apply to you with your amateur athletic organization.

Fitmore is not responsible or accountable for your ineligibility as an amateur athlete as a result of

your usage of the Platform.

GROUND LAWS AND RULES

a. Eligibility Criteria:

You may only use the Platform if you are of legal age in your country or have permission from

your parent or guardian. Certain Platform services may have age limitations in different

countries. If you detect a minor utilizing our services, please notify us and we will take the

required actions. By using our services, you agree that you are of legal drinking age and are

legally authorized to do so. We accept no responsibility if you do not eligible for our services

under this clause.

Our services are not meant for minors or children who are not legally permitted to access them.

We fully state that we will not be held liable for any such loss or damage. If a user discovers

such minimal usage, he or she must contact us, and we will take the necessary steps to prevent

such entry.

b. Release:

No failure to exercise, or delay in exercising, any right or power granted hereunder by either

party shall be construed as a waiver thereof, nor shall any single or partial exercise of any right

or power granted hereunder prohibit subsequent exercise of that or any other right granted

hereunder. If this Agreement and any relevant purchase or other conditions conflict, the contents

of this Agreement will take precedence.

c. Registration Procedures:

When you sign up for an account with us, you agree to the following:

i. Please provide us with registration information that is accurate, up to date, true, and current.

ii. Maintain the privacy of your registration. Please do not register more than once. Duplicate

registration is not permitted.

iii. You may not establish an account on behalf of another person or transfer your account to

another person without our prior authorization.

iv. Keep your username, password, and other login information safe, and don't let anybody else

use your account.

It is your responsibility to notify us promptly of any unauthorized use of your Fitmore account.

You are liable for anything that occurs through your account, with or without your knowledge.

Every use of your account will be considered personal.

d. Liability Restrictions:

WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR THAT IT AND ITS

SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER DETRIMENTAL MATERIAL.

WE SHALL NOT BE LIABLE FOR ANY DAMAGES OR COSTS RESULTING FROM

YOUR USE OF THE WEBSITE OR THE SITE CONTENT, INCLUDING, WITHOUT

LIMITATION, THE NEED FOR MAINTENANCE OR FIXING BUGS OR INFORMATION.

Except for User Content (described below), all content on our Platform is proprietary. Fitmore or

those from whom we license Content owns the content, which is protected by copyright,

trademark, patent, and other laws. Fitmore maintains all rights that are not clearly stated in these

Terms. We appreciate all of your comments, reviews, and suggestions about our services. You

acknowledge, however, that if you submit any reviews, comments, suggestions, ideas, notations,

conceptual frameworks, or other relevant data (collectively, the "Information"), you grant us the

irreversible, permanent right to use, change, publicly release, or remove the Information for any

purpose whatsoever, without compensation to you or the provider of the Information.

Fitmore owns, registers, and/or licenses all trademarks, service marks, and trade names. By

accessing or using the Platform or Content, you do not get a license or ownership rights to any

trademarks, service marks, or trade names. You agree not to modify or remove any ownership

notices contained in anything downloaded or printed from the Platform.

We grant you a limited, personal, non-transferable, non-sub licensable, and revocable license to

access and use such copyrights or copyrightable works exclusively for their intended purpose

and only for as long as we make such Content freely available to the public. You do not get

ownership rights to the Content, including any trademarks or other intellectual property included

in the Content, and all such Content is intended for personal, non-commercial use only. We

 You will not change or bypass any Platform software or security technology.

 You will not seek personal information from other Platform users, nor will you send

 You will not pretend to be anybody or anything, including athletes, our employees,

personnel, workers, or contractors.

 You will not attempt to probe, scan, or test the vulnerability of any of our system or

network or breach any security or authentication measures.

 You will not send any unsolicited or unauthorized advertising, promotional materials,

email, junk mail, spam, chain letters or other form of solicitation to, through, or with any

assistance from, the Services.

 Violate any applicable law or regulation; or

 Encourage or enable any other third party to do any of the foregoing.

We shall have the authority to investigate and prosecute any of the aforementioned breaches to

the fullest extent of the law. We reserve the right to involve and work with law enforcement

agencies in pursuing users who breach these Terms. You acknowledge that while we have no

obligation to monitor your access to or use of the Services or Collective Content, or to review or

edit any Collective Content, we reserve the right to do so in order to operate the Services, ensure

your compliance with these Terms, investigate a complaint, or comply with applicable law or the

order or requirement of a court, administrative agency, or other governmental body.

We retain the right, at our sole discretion, to delete or deactivate access to any member Content

or collective Content that we deem to be in violation of these Terms or otherwise damaging to

the Services at any time and without prior notice. If we suspect criminal conduct, we retain the

right to fully comply with law enforcement and to involve and share information with law

enforcement, governmental agencies, or other oversight organizations.

i. Interactions by Users

We are not liable for your interactions with other Platform users or any loss or harm you may

experience as a result of these interactions, to the extent permitted by applicable law. When

engaging with other users (including individuals you do not know) on the Platform, you shall be

responsible and take measures. Consider investigating, bringing a companion, meeting in public

places, and informing someone of your plans before meeting someone face to face. Fitmore is

not required to become involved in any user disputes, although it may do so at its discretion.

The Platform, Content, and materials and items available through this Platform are offered "AS

IS." We make no guarantees of any kind, including those regarding the Platform's accuracy,

adequacy, usefulness, reliability, or otherwise. We cannot promise that the Platform will be

error-free or uninterrupted, that any faults will be repaired, or that the Platform is free of viruses

or other dangerous components.

Fitmore expressly disclaims all warranties, express or implied, regarding the Platform, Content,

User Content, and any products or services obtained or accessed through the Platform, including,

but not limited to, implied warranties of title, merchantability, fitness for a particular purpose,

and non-infringement, to the fullest extent permitted by law.

To the extent applicable legislation does not permit otherwise, you are entirely liable for any

damage to your Device as a consequence of accessing the Platform. We hope you enjoy and get

the most out of the Platform; but, no results are guaranteed.

j. Infringement on Copyright:

Please speak with your legal counsel before filing a notification with us since fraudulent claims

may result in fines. We have the right to cancel the accounts of Platform users who are found to

be infringing third-party copyrights. If you suspect your work has been inappropriately

transferred on the Platform, resulting in infringement, please report us with the following

information:

i. name, address, phone number, email address, and electronic or physical signature of the

copyright holder or the person authorized to act on his or her behalf;

ii. a description of the allegedly infringed copyrighted work;

iii. a description of where on the Platform the allegedly infringing content can be found;

iv. a written declaration that you believe the disputed use is not authorized by the copyright

owner, its agent, or the law; and

v. a declaration made under penalty of perjury (depending on relevant legislation) by you

that the above information in your notification is correct and that you are the copyright

owner or have authority to act on the copyright owner's behalf.

This Platform may contain connections to third-party websites. These links are given purely for

your convenience and do not constitute an endorsement by us of the material on those other sites.

We are not responsible for the quality of any linked sites and make no claims as to the truth or

completeness of contents on such websites. You do so with your own risk if you select to access

l. Termination:

Fitmore has the right to discontinue or alter any Fitmore Platform, member programme, product,

or service at any time and without warning.

Fitmore reserves the right, subject to applicable legislation, to cancel or suspend your account,

remove your profile or any of your User Content, and restrict your use of all or any portion of the

Platform at any time and for any reason. These Terms will apply even if your account is

cancelled or you cease using the Platform.

m. Liability Limitation/Indemnification

We want you to have pleasure on our Platform, but Fitmore also has to defend itself from any

harm you may bring. Certain restrictions or exclusions on obligations, legal warranties, and

remedies are not permitted in some countries, therefore these exclusions and limitations may not

apply to you.

You agree to indemnify, defend, and hold Fitmore and its affiliates, officers, directors,

employees, agents, licensors, and suppliers harmless from and against any and all claims, losses,

liabilities, expenses, damages, and costs, including, without limitation, legal fees, arising from or

relating in any way to your User Content, your use of Content, your use of the Platform, your

conduct in connection with the Platform or with other Platform users, or any violation of these

Terms and Conditions. You hereby fully and permanently release and discharge the Fitmore

Parties from any and all claims or causes of action you may have for damages connected in any

way to your use of the Platform, for yourself and on behalf of your heirs, estate, insurers,

successors, and assigns.
